Nicole is a director in ENSafrica’s dispute resolution department, specifically in the insurance practice group. She has over 11 years’ experience specialising in a wide variety of insurance claims and disputes (with a specific focus on all aspects pertaining to cyber insurance and cyber breach incidents, construction, infrastructure and engineering claims), complex data protection litigation, construction disputes (specifically in renewable energy and large projects), guarantee and on-demand bonds claims and general commercial disputes. She regularly provides training to a wide range of corporations, and frequently writes articles and publications, on a variety of important legal developments. 

She specialises in data protection and cyber risk matters, including the Protection of Personal Information Act (POPIA), the handling cyber breach incidents, the mitigation of risks arising from cyber incidents and the complex litigation arising from breaches of data protection legislation. She has been involved in a number of cross-border disputes, and advised on a variety of data breaches which span across South Africa, Europe and the United Kingdom and the transfer of personal information to foreign jurisdictions. 

Nicole is an accredited mediator and has experience in representing clients in a variety of alternative dispute resolution procedures, including mediation, arbitration and adjudication. She has been involved in a number of reported decisions in various divisions of the High Court of South Africa and the Supreme Court of Appeal.

Regulatory Developments: POPIA and the Transition from Non-Regulation

From 1 July, businesses will have to comply with South Africa’s Protection of Personal Information Act (POPIA). This comprehensive legislation marks a sea change in the way businesses are regulated for data protection, including introducing a requirement to report data breaches. This panel will discuss how businesses can make the transition needed in order to comply with the new legislation.
